Change in Indiana Law for Not-For-Profits involving food as of July 1, 2007.
Not-For-Profit organizations are allowed to serve food to the public 15 days in a calander
year without being inspected and permitted by the Health Department.
Churches groups are unlimited as to the number of fund raising events they may hold where food
will be sold or consumed by the public, provided the church members make the food. However, if they operate
a "soup kitchen" which serves food daily, they are subject to State Code regulations and requirements and
Health Department inspections.
Organizers of the Fair, Festivals, and other events in the county may require not-for-profits
to have an "educational evulation" by the Health Department to ensure they are meeting minimun safety standards. The
Health Department will then provide the organizers with a report on each booth and they (the organizers) will be responsible
for enforcement. Permits will no longer be issued to not-for-profit booths but after doing an educational
evulation, a "certificate" will be issued stating that the booth agrees to follow the minimum standards.
